Terms & conditions

The agreement between you and The Wishlist when you order from The Wishlist.

1. Who we are

The Wishlist is a trading name of Zonda Creative LLC, a Delaware limited liability company. Our legal postal address is 1111B Governors Ave, Ste 37778, Dover, DE 19904, United States. The Wishlist is the seller and merchant of record for purchases made through thewishlist.shop.

2. Third-party sourcing

We are an independent retailer, not a manufacturer. The products we sell are made by third-party manufacturers and are dispatched to you directly by third-party fulfilment partners on our behalf. This does not reduce your rights: your contract of sale is with us, and we remain responsible for the order.

3. Orders

Placing an order is an offer to buy. A contract is formed only when we confirm dispatch. We may decline or cancel an order - with a full refund - if an item is unavailable, if a price or description was clearly incorrect, if we cannot ship to your destination, or if we suspect fraudulent use of a payment method.

4. Prices and payment

Prices are shown in the currency indicated on the product page. Item prices, shipping charges and any taxes collected by The Wishlist are shown separately and confirmed before you pay. Taxes, VAT, customs duties and import charges vary by destination. Where The Wishlist is required and configured to collect tax at checkout, the applicable amount will be shown before payment. Other customs duties, import taxes, carrier charges or handling fees not collected by The Wishlist may be payable by the recipient where applicable. Payment is processed through our payment provider. The Wishlist does not receive or store your full card number or card security code.

5. Product information

We aim to present product specifications, sizing, warnings and other information supplied by manufacturers and suppliers accurately. Unless expressly stated, The Wishlist does not manufacture or independently laboratory-test the products. Product information may be updated when we receive revised information from the manufacturer or supplier.

6. Safe use

Products may have different age, use, care and supervision requirements. Please follow the product-specific instructions, warnings and age guidance shown on the product page or supplied with the item. Adult supervision, where appropriate, does not replace compliance with product-specific instructions or warnings. Stop using a product if it becomes damaged, excessively worn or otherwise appears unsafe.

7. Delivery, cancellation and returns

Delivery terms are set out in our Shipping & Delivery Policy, and cancellation, return and refund terms are set out in our Returns & Refunds Policy. Both form part of these Terms.

Nothing in these Terms limits any statutory consumer rights that cannot lawfully be excluded or limited.

Delivery terms are set out on our shipping page, and cancellation, return and refund terms on our returns page. Both form part of these terms. Nothing in these terms limits your statutory consumer rights.

8. Liability

Nothing in these Terms excludes or limits any liability, statutory consumer remedy or other right that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation and, where applicable, death or personal injury caused by negligence. To the fullest extent permitted by applicable law, The Wishlist is not liable for losses that were not reasonably foreseeable when the contract was formed or for losses caused by circumstances outside our reasonable control. Nothing in this section limits any responsibility imposed on The Wishlist by applicable law in relation to product conformity, delivery, refunds or consumer protection.

9. Intellectual property

The The Wishlist name, logo, site content and product copy are our property or used under licence, and may not be reproduced without written permission.

10. Changes and governing law

We may update these Terms from time to time. The version in effect when you place an order is the version that applies to that purchase. These Terms are governed by the laws of the State of Delaware, United States, except that this choice of law does not deprive consumers of any mandatory protections available under laws that apply in their country of residence. Nothing in this section prevents a consumer from bringing a claim before any court, regulator or other authority that has jurisdiction under applicable mandatory law.
